DRAFT for legal review, not yet in force. Not legal advice. Version 0.1, 2026-10-28. Written in plain English for a lawyer to review before launch. Anything in [square brackets] is a placeholder; anything marked "(check)" needs confirming.
Flewaway terms of use
These terms are the agreement between you and [Operator legal name] (ABN [ABN]) ("Flewaway", "we", "us") for using Flewaway, a travel-planning app with an AI helper, Flew AI. Please read them with the privacy policy, which explains what we do with your information.
By creating an account, or using Flewaway, you agree to these terms. If you don't agree, please don't use Flewaway.
The short version
- You must be 16 or over.
- Your trips, journal and photos are yours. We only use them to run Flewaway for you.
- Flewaway helps you plan. It isn't a travel agent and it doesn't book anything. Prices, times and AI answers are estimates: always check official sources before you rely on them, especially for safety, visas and health.
- If you tap a link to a partner, you're dealing with them, not us.
- Your rights under Australian Consumer Law (and your own country's consumer law) always apply. Nothing here takes them away.
1. Who can use Flewaway
- You must be 16 or older. When you create an account, you confirm that you are.
- If you're 16 or 17, you can use Flewaway, but Flew AI won't suggest bars, nightlife or drinking. [Rules for buying Flew Pass when under 18 to be decided before it goes on sale; for example, a parent or guardian's agreement.]
- You must be able to agree to these terms where you live, and not be barred from using Flewaway by law.
2. Your account
- You need an account to keep anything in Flewaway (trips, journals, Flew AI chats and so on). You can look around without one, and try one plan that stays on your device until you create an account.
- You sign in with a code we email you, or with Google. Keep access to your email account safe: anyone who can read your email can sign in to Flewaway as you. Never share your sign-in code.
- Give us an email address that's yours and that works.
- You're responsible for what happens in your account. If you think someone else has used it, use Sign out everywhere and tell us at [contact email].
- One account per person. Don't share an account or sign up for someone else.
3. Using Flewaway properly
You agree not to:
- break the law, or use Flewaway to plan or help with anything illegal or dangerous (for example fake documents, overstaying a visa, dodging fares, or harming anyone)
- upload anything you don't have the right to share, or anything unlawful, abusive, threatening, hateful or sexually explicit
- add other people's personal information (names, photos, details) without a good reason and, where needed, their permission
- harass or abuse anyone, including through Flew AI
- try to get into other people's accounts or data, or into parts of Flewaway you're not meant to reach
- copy, scrape, crawl or download Flewaway's content or data in bulk, or use bots or automated tools on Flewaway, except as Flewaway's features allow
- get around Flewaway's limits, including Flew AI's monthly allowance, the free AI-built trip, rate limits or Flew Pass
- try to make Flew AI ignore its instructions, reveal how it's set up, or produce harmful content
- use Flew AI for anything the AI provider's usage rules forbid (check: whether Anthropic's usage policy must be passed on to users)
- interfere with Flewaway's servers or security, or upload viruses or harmful code
- resell Flewaway or use it to build a competing service, or pretend to be Flewaway or someone else.
We may remove content, or limit, suspend or close an account, that breaks these rules (section 11).
4. Your content
"Your content" means what you put into Flewaway: trips, plans, notes, Moments, photos, receipts, spending, packing lists, check-ins, your travel profile, what Flew AI remembers with your permission, and your chats.
- You own your content. We don't claim ownership of it.
- You give us permission to use it only to run Flewaway for you. You grant us a worldwide, non-exclusive, royalty-free licence to store, copy, process, send and show your content, only to provide, secure and support Flewaway for you (including sending it to our service providers, such as Cloudflare for hosting and Anthropic for Flew AI, as the privacy policy explains). This licence ends when you delete the content or your account, apart from short-lived recovery copies described in the privacy policy.
- We don't sell your content, use it for advertising, use it to train AI models, or make it public. If we add features to share content with other people later, sharing will be your choice.
- You're responsible for your content, and for having the right to add it (for example, photos of other people).
- Keep your own copies. We work hard to keep your data safe, but you can download everything at any time (Download my data), and we recommend you do, especially before a big trip.
- Your reviews stay on your device for now, and aren't shown to anyone else.
5. Flewaway's content and others' content
- Flewaway's app, design, name, logo, place guides, plans and data are owned by us or our licensors. You can use them for your own personal travel. You can't copy, sell or republish them in bulk.
- Some of Flewaway's information comes from open sources with their own licences, such as Wikipedia (summaries are rewritten in Flewaway's own words, with the source linked), Wikimedia Commons and Unsplash photos (each credited), OpenFreeMap and OpenStreetMap map data, NASA imagery, and MET Norway forecasts. Their licences and credits apply to that material.
- Reviews labelled "Sample review" and tours labelled "Sample" are examples written by Flewaway, not from real travellers or real businesses.
- Plans and answers Flew AI writes for you are yours to use for your trip. Others may get similar answers.
- Feedback: if you send us ideas, reports or suggestions, we can use them to improve Flewaway without owing you anything.
6. Travel information and AI answers are estimates
Please read this part carefully.
- Flewaway isn't a travel agent. Flewaway helps you plan and keep track of your trip. It doesn't sell, book or reserve anything (flights, trains, beds, tours or tickets), and nothing in Flewaway is booked until you book it yourself with the provider. Flew AI never books or pays for anything.
- Prices are estimates. Prices are approximate (shown with "≈"), usually Flewaway's estimate or a published price that may have changed. Exchange rates are reference rates, not what your bank will charge. Budgets, totals and "under or over budget" are guides, not quotes.
- Times, opening hours, transport and holidays change. Travel times are rough estimates from distance. Opening hours, closing days, seasons, strikes, events and booking windows can change without notice.
- Flew AI can be wrong. It's an AI, and it can misunderstand you, rely on out-of-date information or make mistakes. "Researched" and "checked" information shows its source and date: check the source yourself.
- Always check official sources before you rely on anything important, including prices, opening times, transport, entry rules, visas, health requirements and safety. Flewaway points you to official pages, but doesn't give legal, visa, medical, insurance or financial advice.
- Your safety is your responsibility. Hikes, mountains, water, weather and travelling at night carry real risks. Check local conditions, weather, the last lift or bus, and official warnings (such as Smartraveller or SafeTravel), and carry what you need. Flewaway isn't an emergency service. In an emergency, call the local emergency number (112 in Europe).
- Weather forecasts come from MET Norway and may be wrong. Anything further than about nine days out is what's usual for the month, not a forecast.
- Money features only add up what you enter. "Settle up" suggests payments between friends; Flewaway doesn't move money.
- Offline: Flewaway is built to work with patchy data, but it can't guarantee everything will open offline or that your data will sync straight away.
7. Links, partners and commissions
- Flewaway links to other businesses' websites, such as tour and ticket sellers (for example Viator, GetYourGuide and Ticketmaster), official sites and Google Maps. When you tap a link, you leave Flewaway. Any booking or purchase is between you and that business, on their terms, and they're responsible for it. We're not responsible for their sites, products, prices, availability or privacy practices.
- Commissions: Flewaway may earn a commission when you book through some links, at no extra cost to you. Links that may earn us a commission are labelled "We may earn a commission". Links that don't earn anything yet are labelled that way too. A commission never changes the price you pay, and Flew AI doesn't push you to buy or book.
- Flewaway has no display ads.
8. Flew Pass
Flew Pass is Flewaway's paid plan. It unlocks extra features, such as Flewaway building and changing your plans, a larger Flew AI allowance, Thorough answers, photos in Flew AI and looking things up online.
- Flew Pass isn't on sale yet. [While Flewaway is in testing, Flew Pass may be switched on for some accounts free of charge, and can be switched off at any time.]
- [Prices, what's included, billing, automatic renewal, how to cancel and refunds will be set out here before Flew Pass goes on sale.]
- Free AI-built trip: each free account can have one trip of up to 14 days built by Flew AI. Longer trips, and later ones, need Flew Pass.
- Flew AI allowance: Flew AI has a monthly allowance, measured by what answers cost to run. It's shown in the app and resets on the 1st of each month. We may change the allowance; we'll show the change in the app first.
- Nothing in these terms limits your rights under the Australian Consumer Law, including to a refund or other remedy for a major failure (section 13).
9. Changes to Flewaway
Flewaway is new, and we'll keep changing it: adding, changing or removing features, places and partners. If we remove a paid feature you've paid for, we'll tell you first and, where fair, offer a pro-rata refund. [Detail to set with Flew Pass.]
10. Availability
We aim to keep Flewaway running smoothly, but it may sometimes be slow, unavailable or have errors, including because of the services it relies on (such as Cloudflare, Anthropic, map and weather providers). We don't promise that Flewaway will always be available or error-free, except as the law requires (section 13).
11. Suspension and ending
- You can stop using Flewaway at any time, and delete your account from You → Account → Delete my account. Your data is deleted as the privacy policy explains.
- We may suspend or close your account, or remove content, if you seriously or repeatedly break these terms, if the law requires it, or to protect people, Flewaway or others from harm. Where it's reasonable, we'll warn you first and give you a chance to fix things or download your data.
- We may stop running Flewaway. If we do, we'll give you at least [30] days' notice where we can, so you can download your data, and we'll refund any unused part of a paid subscription.
- Sections 4 (the parts about your content after you leave), 5, 6, 12, 13, 14 and 15 continue after these terms end.
12. Our responsibility to you
- Flewaway is provided for your personal, non-commercial travel planning.
- To the extent the law allows, and subject to section 13:
- we're not responsible for losses caused by relying on prices, times, opening hours, forecasts, AI answers or other information in Flewaway that you could reasonably have checked with an official source, or for anything a partner or other business does
- we're not responsible for losses we couldn't reasonably have foreseen, or that are caused by things outside our reasonable control (for example outages at our providers, or natural disasters)
- our total liability to you for anything to do with Flewaway is limited to the greater of [A$100] and what you paid us for Flew Pass in the 12 months before the claim. [Amount to set with the lawyer.]
- None of this limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit.
13. Australian Consumer Law and your rights
Our services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those guarantees, or any other right or remedy you have under the Australian Consumer Law or another law that can't be excluded.
If you're in New Zealand, nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you're in the EU, the UK or another country, you keep any rights your local consumer law gives you that can't be taken away by agreement.
14. If something goes wrong between us
Please talk to us first at [contact email]. Most problems can be fixed quickly. If we can't sort it out together, either of us can take it further.
15. Law that applies
These terms are governed by the law of [State], Australia. You and we agree that the courts of [State], Australia (and courts that can hear appeals from them) can hear disputes, but this doesn't stop you bringing a claim in the courts where you live if your local law allows it.
16. Changes to these terms
We may update these terms, for example when Flew Pass goes on sale or new features arrive. The date at the top shows the latest version. If a change matters, we'll tell you in the app, and by email where appropriate, at least [30] days before it applies, unless it's needed sooner for legal or safety reasons. If you don't agree with a change, you can delete your account before it applies. If you keep using Flewaway after it applies, the new terms apply.
17. General
- These terms, the privacy policy and anything they link to (such as Flew Pass terms, once they exist) are the whole agreement between you and us about Flewaway.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce something straight away, we can still enforce it later.
- We may transfer these terms to a new owner of Flewaway, who must keep to them. You can't transfer your account to someone else.
- We'll send notices to your account's email address or show them in the app.
